DIVORCE:

KINDS OF DIVORCE:

No “fault” divorce: 

This kind of divorce applies when both spouses agree to “irreconcilable differences” and both parties agree to dissolve the marriage. Once both parties have a mutual agreement on how to divide assets/debts and matters pertaining to child support and custody, then a divorce can be obtained. The court always appreciates when both parties reach an agreement prior to court. The court will more likely grant a divorce when there is a mutual agreement presented to the judge.

“Fault” divorce: 

This applies when one spouse alleges adultery, physical abuse or abandonment or other special circumstances. Fault divorces may affect the extent and duration of child support and custody. ANNULMENTS: 

There are two kinds of annulments in Pennsylvania, Void and Voidable

Void annulments can be obtained under these grounds:

  • When spouses are both under the age of 18
  • When one or both spouses were unable to give consent due to mental capacity or incompetence
  • When the marriage is prohibited by law. Pennsylvania will not legally recognize this as a marriage.
  • When the marriage consists of a direct family member (i.e cousins or any family)
  • When the marriage is polygamous or bigamouse.

Voided Annulments can be also be obtained under these grounds:

**Voidable annulments ARE legally recognized as a marriage in Pennsylvania**

  • If both spouses were under the age of 16
  • If both spouses were under the age of 18 and did not get parental consent
  • If the marriage was performed with either spouse under the influence of drug or alcohol
  • If either spouse is physically unable to perform sexual intercourse
  • If the marriage was obtained under coercion, fraud, or duress.
